Terms and Conditions

Important: Please read before you commence your course. This will explain your rights and our terms and conditions. 

1. FOR THE PURPOSES OF THESE TERMS: 

Headings; Number and Gender. The headings of sections and paragraphs are inserted for convenience only and shall not be deemed to constitute part of this agreement or to affect the construction thereof.

The use in this agreement of singular, plural, masculine, feminine and neuter pronouns shall include the others as the context may require.

‘We’ and ‘us’ means PeoplesHR Academy who will provide the services to you.

‘You’ means the student receiving the services.

‘Course’ means a distance learning course or course designed and developed by us including all revisions and updates to such course as we may make from time to time.

‘Course Materials’ means the physical materials relating to any one course, together with all revisions and updates made by us from time to time, which may be in any format and which are required by the student to complete the course.

2. RESPONSIBILITY FOR COURSE MATERIALS

We affirm that the course materials will meet a satisfactory level of quality however; we do not affirm that they will be error free. We reserve the right to amend the course and alter details at its discretion.

You will be responsible for inspecting the course materials as soon as you receive the access to the course material. Furthermore, you will be responsible for informing us about any oversight within 14 days of access to the course material.

3. PAYMENT

The fee for the Online Course (the “Fee”) must be paid in full at the time of registration. Registration is not complete until PeoplesHR Academy has received such full confirmed payment of the Fee.

You agree to provide accurate and complete registration information. Submission of your registration, alongside full payment of the Fee constitute your acceptance of these Terms and Conditions.

4. REFUNDS 

You may withdraw from the course at any time. However, once you are registered and have logged in to the course, you will not receive a refund for any reason.

  5. COPYRIGHTS & INTELLECTUAL PROPERTY RIGHTS

The copyright in and all other intellectual property rights relating to the Course software, data and documentation employed by us and any related materials (“Course materials”) provided to you by us are owned exclusively by us and hereby reserved to PeoplesHR Academy and/or its party licensors. We hereby grant to you a non-exclusive, nontransferable, non-sub-licensable license to use such Course materials solely for the purpose of receiving the Course.  

Under no circumstances may any part of the Course materials be produced or copied in any form or by any means or translated into another language by you without the prior written permission of PeoplesHR Academy.

You shall not delete, amend, alter or deface any confidentiality or proprietary notices on the Course materials.

You shall ensure that you keep confidential the Course materials and comply fully with all use restrictions in relation to Course materials as notified you by PeoplesHR Academy.  

6. CONFIDENTIALITY

Except as otherwise set forth in these Terms & Conditions, each Party may disclose to the other Party certain confidential information under these Terms & Conditions.

Each Party agrees that all code, inventions, know-how, business, technical and financial information or any information specifically designated as confidential or that would be understood to be confidential or proprietary by a reasonable person disclosed to such Party (“Receiving Party”) by the disclosing Party (“Disclosing Party”) constitute the confidential property of the Disclosing Party (“Confidential Information”).

Any PeoplesHR Academy technology, any commercial terms (including pricing) of these Terms & Conditions and any performance information relating to the products shall be deemed Confidential Information of PeoplesHR Academy without any marking or further designation.

Except as expressly authorized herein, the Receiving Party will use (and will ensure that its employees, Affiliates, agents, contractors and any approved third parties use) reasonable efforts (which shall be no less than the efforts used to protect its own confidential information of a similar nature) to prevent the disclosure of any Disclosing Party’s Confidential Information for any purpose other than providing the training contemplated by these Terms & Conditions unless authorized by the Disclosing Party.

7. QUALIFICATIONS

We advise students to check that any qualification attached to any of the courses meets their needs prior to enrolment. We make no claims that your qualification will be recognized by an individual employer. We would advise you to check with any potential employer of their requirements.

8. TECHNOLOGY REQUIREMENTS

The Online Course is facilitated through an online learning management system. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the course. You will need to ensure you have the proper technology at the time of registration as will be provided with the registration details
PeoplesHR Academy is not responsible for any errors or failures in relation to your ability to access the Online Course, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on PeoplesHR Academy or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system

9. DATA PROTECTION

We are committed to protecting your privacy and keeping your personal information secure. We will not disclose your details to any person unless you have given your consent or we are compelled to do so by law or in response to a valid, legally compliant request by any law enforcement agency or government authority.

Please note: We are unable to correspond with any third party regarding your course, course progression, certification or payments. Any information/correspondence required must be requested by the registered student or parent if the student is less than 18 years of age.

10. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We warrant that we will carry out the service to you with a reasonable level of care and skill. 

Any liability under any agreement between you and us shall be limited to any sums paid by you to us. As far as permitted by law, we shall not be liable to any person for losses or damages that were not reasonably foreseeable and that were not caused by any breach on our part. 

We shall not be liable to any person for any direct or indirect loss or damage as a result of your course enrolment. Any liability that does arise will be limited to the course fee paid.

11. WAIVER 

None of the conditions or provisions of this Agreement shall be held to have been waived by either party, except by an instrument in writing signed by a duly authorized officer or representative of each party. The waiver by either party of any right hereunder or the failure to enforce at any time any of the provisions of this Agreement, or any rights with respect thereto, shall not be deemed to be a waiver of any other rights hereunder or any breach or failure of performance of the other party.

12. FORCE MAJEURE

Neither Party shall be liable to the other for any delay or failure to perform any obligation under these Terms & Conditions (except for a failure to pay fees) if the delay or failure is due to unforeseen events which are beyond the reasonable control of such Party, such as a strike, blockade, war, act of terrorism, riot, natural disaster, failure or diminishment of power or telecommunications or data networks or services, or refusal of a license by a government agency (each a “Force Majeure Event”).

13. OTHER TERMS & CONDITIONS 

If at our discretion we afford you any relaxation of these terms, this shall in no way affect our rights under these terms & conditions.
These terms shall be interpreted in all respects in accordance with the laws of Singapore The parties hereby submit to the exclusive jurisdiction of the Singapore Courts for the determination of any question or dispute arising in connection with this terms of service.

The agreement is the entire agreement between you and PeoplesHR Academy relating to Online Course and supersedes all prior or contemporaneous oral or written communications, proposals and representations with respect to the Online Course or any other subject matter covered by these Terms & Conditions. If the whole or any part of any clause(s) of this Agreement is or becomes invalid for any reason, that invalidity shall not affect the validity of any other provision.

You are required to notify us in writing of any changes to your postal address or personal details.
